Our Obligations to You

Responsible Lending Obligations

Under the NCCP Act, we are obliged to ensure that any loan, credit limit increase, or lease we assist you with is suitable for your needs and objectives. To assess this, we are required by law to:

  • Make reasonable enquiries about your requirements and objectives.

  • Make reasonable enquiries about your financial situation.

  • Take reasonable steps to verify your financial situation.

A loan or lease will be deemed unsuitable if, at the time of assessment, it is likely that:

  1. You could not pay or could only pay with substantial hardship.

  2. The credit product does not meet your stated requirements and objectives.

(For example, if you can only repay a loan by selling your principal place of residence, it is presumed the loan will cause substantial hardship unless proven otherwise).

We will provide you with a copy of our preliminary credit assessment upon request within 7 years of assisting you.

Note on Property Valuation: If we arrange finance for real estate, you must conduct your own enquiries regarding property value and growth potential. Any valuation we obtain is for lender assessment only and should not be relied upon by you.

Best Interests Duty

When providing credit assistance, we are legally required to act in your best interests.

  • Any product recommended will be aligned with your needs and objectives, with written justifications provided.

  • In cases of actual, potential, or perceived conflicts of interest, we will disclose them and prioritize your interests above our own or any third party's at all times.

Fees & Commissions

Fees Payable by You

As the licensee, we do not charge you directly for our services, as we are paid commissions by the financier. However:

  • Your credit representative may charge a fee for their services. Details will be outlined in a Quote and Proposal document provided prior to lodging your application.

  • You may need to pay standard lender fees (e.g., application fees, valuation fees).

Commissions Received by Us

We may receive upfront and trail commissions from lenders for arranging finance. These are paid by the lender and are not fees charged to you. Commission rates generally range between 0.60% and 0.75%. Full details of these commissions will be disclosed to you during the application process.

Commissions Paid by Us

We may pay referral fees to third parties (such as accountants, real estate agents, or lawyers) who refer clients to us. These fees align with standard business practice and are not payable by you.

Other Benefits & Tiered Services

Your credit representative maintains a centralized register recording all gifts, hospitality, and non-monetary benefits, which is available upon request. They may also have access to tiered servicing arrangements with certain lenders, providing non-monetary benefits like faster processing or priority service. Any applicable arrangements will be fully disclosed when recommendations are made.

Dispute Resolution
